Are the states responsible if they license illegals and they have a fatal wreck ?

Last week there was a terrible accident involving a semi truck and a minivan with a family of 3 in the van. You might have seen the video ? The semi was in Florida on the freeway and decided to make a u-turn from the right-hand lane of the freeway, across the left lane, and through the grass in the median strip, and when he swung the truck and trailer across the lanes, they cut off the van and it went right under the trailer, killing everyone in the van.
The driver of the truck just looks put out, and not concerned that he just killed 3 innocent people.

The two people in the semi were illegals from India, who went to California and got a license, and then started driving the truck cross-country. They have been arrested and charged with the deaths of the family who were killed in the accident.
People are now asking about the responsibility of the State of California , and Governor Newsom, for giving these illegals a license in the first place.

It seems to me that the states that license these illegals should have a responsibility when the illegals cause deaths and accidents like this. It is just a good thing that more vehicles were not on the highway right then, or more people would have been killed .

It will likely be decided in the courts. California was negligent (reportedly) by giving commercial drivers licenses to any illegal who attested they had driven trucks in their home country. Many illegals reportedly took that to mean if they had driven a pickup 15 miles in (wherever) it was driving a truck, and they knew they could get good-paying jobs driving trucks. It could be California will be found negligent in the certification process, or the drivers could be found guilty of perjury for misleading attestations. Who knows? All people driving on the roads, especially the Interstates, are endangered by these folks.

You have to remember that there is a legal difference between someone who is "Not Domiciled in a US State" and someone whose legal status is a "Noncitizen", aka an Illegal Alien prior to 2021. As far as personal liability goes, this photo says it all...

I'm sure that photo and the video showing the driver casually putting the truck in park and turning the engine off will both be submitted as evidence in court.

As far as governmental liability goes, whether government agencies are liable for the crimes of individual is laughable at best. At least under the Rule of Law... Laws created by Congress are still laws, even if you disagree with them. There's a lot of laws I disagree with, but to say anyone else if responsible for your choices is stupid.

There is a guy named James Spann who reports on weather and road conditions here in Alabama, so I follow him on facebook. It seems like more often now, the bad accidents involve a semi truck, and it always makes me wonder about the driver. There was another one here yesterday, the driver came down the off-ramp way too fast, ran a red light and tried to make a sharp corner at the bottom. He ended up flipping his trailer and spilling oil over everything and more cars being involved.

The facebook article didn’t say anything about the truck driver, but it really made me wonder if it was another illegal driving the semi. It is likely that ICE will put someone at some of the major truck weigh stations and pick up these dangerous drivers and ship them back to their own country before they cause accidents.
The legal truck drivers on social media are probably the most upset about the illegals, because they are always on the highways and see what awful driving is going on out there.

My point was, it doesn't matter if someone who commits a crime is an illegal alien or not. Nobody else is responsible for what they do. And as far as driving goes, you know it's a crime to not have proper insurance. Mine costs me $125 a month. I've looked at every part of the policy to see if I could reduce that amount, but what I have covers everything, so I left it alone.

We were members of NumbersUSA in 2008 'below' and ALIPAC, it went nowhere because until it personally affects Americans they just don't think about the price their children will pay living in a third world for their inaction.
Half the crime in America is from illegals working for Cartel.

I was a member of NumbersUSA and ALIPAc in 2008, Roy Beck came to one of our rallys for America at the court house park downtown, when less than 40 people showed up that was the end of my involvement.
Roy Beck 'man in video above' came to the rally so did local farmers protesting against us.
Most of our allies in this protest were blacks and not surprising, legal immigrants since these two groups lose the most jobs from illegals.

Truckers are the ones who inspired me in the first place to get involved since one of our neighbors was one.
Truckers said the highways are more dangerous for many reasons, like used tires blowing up or losing retreads that cause lots of wrecks. Many trucks from Mexico also are unsafe no inspection or just old.

While I do agree with you that the driver of this truck bears the weight of responsibility for killing three innocent people, and he will certainly be sent to prison or deported for doing this; I also think that the company that hires a person, knowing that they cannot pass the CDL driving requirements, and in many cases cannot read or speak English, holds a responsibility as well.

And if a state knowingly gives the CDL license to these people, they should be held responsible and fined.
Otherwise, as long as the illegals can get the license and are hired by some company, they will continue to be on our highways and causing wrecks and killing people.
Some of the weigh stations are giving the foreign drivers a Dr. Seuss book, and if they cannot read it, they are immediately stopped from driving the truck. I think this is a good idea, but it needs to go a step further where they are turned over to ICE and deported.

This is no different than the courts letting criminals loose with no bail and they immediately commit other crimes. It is the criminal doing it, but our legal system allowing it to happen.

It looks like this might not be the first catastrophe that this illegal truck driver has caused. Here is a driver by the same name who caused a bridge in Arkansas to collapse a few years ago, because he could not read the weight limit sign on the bridge, and his lad was WAY over the legal limit weight.

Difference between criminal and civil liability. The driver(s) are certainly the ones criminally responsible, but California and other states issuing CDLs to non-qualified applicants may be civilly liable. Federal courts will decide this issue.

This is a screenshot from yet another huge crash with the foreign truck drivers who do not understand English, or know how to drive one of these big semi trucks. There were 2-3 cars, and at least two big trucks that I could see from watching the video.
